1. About these terms

MHive (“we”, “us”) runs the MHive platform: the MHive websites and apps, and the services behind them. These terms cover your use of the platform.

MHive is Manhive Technology Ltd, a company registered in the Abu Dhabi Global Market (ADGM). Our address is 2201.C28-D125, Office 2201, Floor 22, Sky Tower, Shams Abu Dhabi, Al Reem Island, Abu Dhabi, United Arab Emirates. You can write to us at [email protected].

You agree to these terms when you sign in, make an account, or use the platform in any other way. If you do not agree, please do not use it.

If you use the platform for a company, you also agree for that company, and you confirm you are allowed to do so.

2. Signed agreements come first

If your company has a signed agreement with MHive, that agreement applies to you. Where it says something different from these terms, the signed agreement wins.

3. Accounts

  • Employer and agency accounts are set up by the MHive team. Applicants make their own account. An agency can also make a profile for an applicant who has no account.
  • You must be at least 18 years old. An agency must not add a profile for anyone under 18.
  • Keep your sign-in details secret. You are responsible for what happens under your account.
  • Keep your details correct and up to date. Tell us at once if you think someone else has used your account.

4. Using the platform

You must not:

  • break any law, or help anyone else break one;
  • post a job, a profile or a document that is false or misleading;
  • upload information about a person unless you have the right to share it;
  • upload a passport scan as an education or certificate document;
  • share your account, or let anyone else sign in as you;
  • try to reach data or accounts that are not yours;
  • use applicant data for anything other than hiring;
  • copy, scrape, resell or disrupt the platform, or reach it with automated tools other than the ones we provide.

If you connect your own tools to the platform, such as an AI assistant or your own software, you are responsible for them and for the data they receive.

5. Your content

You keep ownership of what you put on the platform: job posts, profiles and documents.

You give us permission to store, copy, show, change the format of, and process it so the platform can work. This includes matching applicants to jobs and showing profiles to the employers and agencies involved. We may also use totals that do not name anyone, to understand and improve the platform.

You confirm you have the right to share it.

An agency that adds or manages an applicant’s profile confirms that:

  • the applicant knows about it and has agreed to it;
  • the applicant has been shown our Privacy Policy in a language they understand;
  • the applicant knows their profile will be matched automatically and shown to employers, including in other countries;
  • the law allows the agency to hold and share each detail and document it adds, including the passport number;
  • the details are true and up to date, as far as the agency knows.

The agency must keep proof of this and show it to us if we ask.

6. Applicant data

If you are an employer or an agency, you may use the profiles and documents you see only to hire for the job in question. You must not use them for anything else, pass them to anyone who does not need them for that hiring, or keep them longer than you need. If you pass them to anyone else, such as your own client, you must make sure they follow these rules, and you are responsible for what they do with them.

You must keep them safe, and tell us at once if they are lost, leaked or misused. You are responsible for what you do with them under the data protection laws that apply to you.

7. Fair recruitment

If you are an employer or an agency, you confirm that:

  • you hold every licence and registration the law requires for the recruiting you do;
  • you do not charge an applicant any fee or cost that the law does not allow;
  • you do not keep an applicant’s passport or identity papers against their will;
  • every job you post is real, and its pay and conditions are stated truthfully;
  • you do not use the platform for forced labour, human trafficking, or any work that is against the law.

We may ask you for proof. Asking, or not asking, does not mean we have checked. We may report what we see to the authorities.

8. What MHive is, and is not

MHive is a platform that connects employers, agencies and applicants. We are not an employer or a recruitment agency. We are not a party to any job offer, employment contract or placement.

Any agreement or dispute between users is between them. This includes job offers, contracts, pay, fees, placements, and what an agency and an applicant owe each other. MHive is not a party to it and does not have to step in. As far as the law allows, you will not hold MHive responsible for it.

Nothing in these terms makes MHive your employer, your agent or your partner.

9. Matches, scores and checks

We do not promise that an employer will find a worker, or that an applicant will find a job. Matches and scores are made automatically from what profiles and job posts say. We do not check that what they say is true. A match or a high score is not a recommendation. No match or a low score is not a judgement about a person. Do not rely on them alone.

You are responsible for your own checks, such as identity, qualifications, licences, medical fitness, visas and the right to work. You are also responsible for following the labour, recruitment and immigration laws that apply to you.

We may look at a job post, a profile, a submission or a document. We may approve it, hide it, or mark a step as done. We do this to keep the process moving. It is not a promise that anything is true, real, valid or lawful, and it does not replace your own checks. This holds even when we or the platform say that something has been verified or approved.

Employers choose the requirements on a job post, including any age range or sex. The employer confirms that each requirement is lawful where the job is and where the hiring takes place. We do not check this. We may remove a requirement or a job post that we believe is unlawful.

10. Fees

Any fees are set out in your signed agreement with MHive.

11. Our platform

The MHive software, name, logo and design belong to MHive. You may use the platform for its purpose for as long as you follow these terms. Nothing else is transferred to you.

12. Availability and warranty

We work to keep the platform running, but we provide it “as is” and “as available”. We may change, pause or remove features.

As far as the law allows, we give no warranties of any kind. This includes any warranty that the platform will be uninterrupted, free of errors, or fit for a particular purpose.

13. Limit of liability

As far as the law allows:

  • we are not liable for lost profit, lost business, lost data, or any indirect or consequential loss;
  • we are not liable for what employers, agencies, applicants or other users do or fail to do;
  • we are not liable for loss that comes from a hiring decision, a job offer or placement that does not go ahead, a worker who does not arrive or is not fit for the job, a visa or permit that is refused, a profile or document that turns out to be false, or money paid between users;
  • we are not liable for delays or failures caused by events outside our reasonable control;
  • our total liability to you is limited to the fees you paid MHive in the 12 months before the claim, or 100 US dollars if that is more.

Nothing in these terms limits liability that the law does not allow us to limit. For example, we do not limit liability for fraud, or for death or injury caused by our carelessness.

14. Your responsibility to us

If you are an employer or an agency, and we face a claim, a fine or a loss because of your content, your recruiting, your use of applicant data, or because you broke these terms or the law, you will cover it. This includes our reasonable legal costs.

If you are an applicant, you are responsible for loss you cause us by breaking these terms on purpose or by giving false information.

15. Suspending or closing an account

We may suspend or close an account, and hide or remove any job post, profile or document, if we believe it breaks these terms or the law, or puts the platform, a user or an applicant at risk. We may also do this if your company’s agreement with MHive ends. We can act without warning when we need to act fast.

You may stop using the platform at any time and ask us to close your account.

When an account is closed, your right to use the platform ends. These parts of the terms still apply after that: your content, applicant data, what MHive is, matches, scores and checks, liability, your responsibility to us, and the general terms. Closing an account does not by itself delete the data linked to it. Our Privacy Policy explains what we keep.

16. Privacy

Our Privacy Policy explains how we handle personal data. Nothing in these terms takes away rights the law gives you over your personal data.

17. Changes to these terms

We may update these terms. We will post the new version here with a new date. If a change matters to how you use the platform, we will try to tell you on the platform or by email before it applies.

If you keep using the platform after the new version is posted, you accept the new terms. If you do not accept them, stop using the platform and ask us to close your account.

18. General

If a court finds that part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.

We may pass these terms to a new owner of MHive. You may not pass your account or your rights to anyone else.

These terms are written in English. If we give you a translation and it differs from the English, the English version applies, unless the law where you live says otherwise.

These terms are governed by the law of the Abu Dhabi Global Market (ADGM). Only the ADGM Courts can decide a dispute about these terms or the platform. If you use the platform for yourself and not for a company, this does not take away any right the law where you live gives you to use your own courts.

Only you and MHive, or a new owner of MHive, have rights under these terms. No one else can enforce them.
